Safety and lawful use. MercLight is for a vehicle you own, parked and stationary, off public roads, for show and demonstration purposes only. Operating non-standard lighting on a public road is illegal in most jurisdictions. You are responsible for how and where you use it.
What the app does
MercLight sends the same kind of diagnostic commands a workshop tool sends, over a Bluetooth OBD adapter, to change how your vehicle's lights behave while the app is running. It does not code, flash or change any setting stored in the vehicle: the vehicle returns to its normal state on its own.
Who may use it
You must be old enough to enter into a binding agreement where you live, or use the app with the permission of a parent or guardian who accepts these terms on your behalf.
Your responsibilities
- Use it only on a vehicle you own or are authorised to work on.
- Use it only off public roads.
- Do not use it while the vehicle is moving or in traffic.
- Comply with the laws that apply where you are.
Adapters and other hardware
MercLight works with Bluetooth OBD adapters that other companies make and sell, including ELM327-compatible adapters and MBito OBD devices. We do not make, sell or support that hardware. Its warranty, safety and terms are a matter between you and its maker or seller, and we are not responsible for a fault in it. Use an adapter only as its maker instructs.
Your vehicle and its warranty
Decisions about your vehicle's warranty belong to its manufacturer and dealer. We cannot promise how they will view the use of a diagnostic app. If that matters to you, ask your dealer before using MercLight.
Use at your own risk
By using MercLight, you understand and accept that you do so at your own risk. You are responsible for any damage that may result from using it, including damage to your vehicle, your adapter or your phone, and for deciding whether, where and how to use it. By continuing to use the app, you confirm that you accept this.
No warranty
The app is provided "as is" and "as available", without warranty or guarantee of any kind, whether express or implied. We do not promise that it will be uninterrupted or free of errors. Vehicles differ, and we cannot guarantee that any particular vehicle, control unit or adapter is supported. A software update to your vehicle, your phone or your adapter can change or end compatibility at any time. The app tells you what it has identified on your car before you buy, but that can change afterwards.
These two sections are subject to the exceptions under "Limitation of liability" below, and they do not affect your statutory rights as a consumer.
Limitation of liability
To the fullest extent permitted by law, we are not liable to you for any loss or damage arising from your use of, or inability to use, the app, whether direct or indirect and whatever its cause, including loss relating to your vehicle, your adapter or your phone. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, such as liability for death or personal injury caused by negligence, or for fraud, and nothing affects your statutory rights as a consumer, including any right to a refund described in our Refund Policy.
Your licence to use the app
We grant you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, with vehicles you own or are authorised to work on. You may not copy, modify, resell, rent or distribute the app, or decompile, disassemble or reverse engineer it, except to the extent the law expressly allows despite this restriction. We keep all rights in the app and in the MercLight name.
Acceptable use
Do not attempt to reverse engineer, extract or redistribute the security material the app relies on, and do not use the app to interfere with a vehicle you do not own.
App Store and Google Play
If you obtained the app from Apple's App Store, these terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app. If the app fails to meet a warranty that applies by law, you may notify Apple, and Apple will refund the purchase price you paid; to the maximum extent the law permits, Apple has no other warranty obligation for the app. Apple is not responsible for any claim relating to the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, consumer protection claims, or claims that the app infringes someone else's intellectual property; we are responsible for those to the extent these terms and the law require. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the App Store and Google Play is also governed by Apple's and Google's own terms.
Trademarks
MercLight is our trademark. Mercedes-Benz is a trademark of Mercedes-Benz Group AG. MBito is a trademark of UAB Mbito. MercLight is independently developed and is not affiliated with, sponsored by, or endorsed by Mercedes-Benz or MBito. Naming a vehicle or a device describes compatibility only.
Termination
You may stop using the app at any time and erase your data from inside the app. We may suspend a device credential that is being used to attack the service.
Changes to these terms
We may update these terms. When we do, the date above changes, and for a material change we publish the new version here before it takes effect. If you keep using the app after that, the updated terms apply; if you do not agree, stop using the app and erase your data.
General
If any part of these terms is found invalid, the rest still applies. These terms, together with the Purchase Terms, the Refund Policy and the Privacy Policy, are the whole agreement between you and us about the app.
